Prosecutors bringing a promotion charge under § 1956(a)(1)(A)(i) have to explain what the payment was meant to accomplish. They also need a qualifying financial transaction involving actual proceeds of specified unlawful activity, and proof that the defendant knew the property came from some form of felony activity. The further question is intent: was the transaction meant to help specified unlawful activity carry on? A trace from criminal receipts to a purchase does not answer that question by itself.

Identify the activity the transaction allegedly promoted

Suppose a person orders false documents for the next round of a fraud and pays with receipts from an earlier round. The order may help explain the alleged intent to promote the fraud. A payment to an ordinary supplier tells us much less. Counsel needs to know what was ordered, what arrived and how the buyer intended to use it. Legitimate work and deception can exist in the same business; neither label settles the purpose of this payment.

The bank records put a date on the receipt and another on the payment. What happened between them? Identify the act alleged to have produced the money, then the work or goods bought with it. Check whether the unlawful activity was still going on when the defendant paid.

Find out what the recipient actually did

An invoice marked “consulting” tells counsel little about the job. Ask for the work behind it. A recruiter may have made the calls billed for and still have been knowingly recruiting more victims. A supplier may instead have filled an ordinary order, with no intention by the buyer to further a crime. Read the instructions sent with the order and compare them with what was delivered. Account records can identify who authorized payment; the emails may say considerably more about why.

Promotion means furthering the unlawful activity. Concealment concerns hiding attributes of the proceeds, while another branch addresses reporting avoidance. Those purposes have separate requirements under § 1956. The law applicable on the offense date also governs whether charging the underlying act as laundering creates a timing or merger problem.

Santos was decided in 2008 under an earlier version of the law. Its dispute over the meaning of proceeds cannot be treated as a rule that only profits count in every laundering case. Congress later enacted § 1956(c)(9), whose definition includes gross receipts. Check the alleged dates before deciding how Santos and the later amendment apply.

Separate proceeds from promotional purpose

Source and receipt
What unlawful activity produced the property, and when was it obtained?
Charged payment
Who sent it, who received it and what work or goods were supplied?
Intent evidence
What supports an intent to advance specified unlawful activity?
This is an example of a records review, not a client’s case. The source of the money and the reason for spending it each need evidence.

Read the payment records together

A receipt shows that somebody was paid. To understand why, the defense may need the order that preceded it, the recipient’s account of the job and the work that followed. An unexplained difference among those records belongs in the review.
