Discuss an investigation, indictment or asset seizure
Has an account been frozen or property seized? When you call, tell the office what the order says and when a response is due. Laundering allegations may concern a bank transfer, a business payment, a real estate purchase, or another transaction. Counsel needs to identify the statute, the alleged criminal proceeds, and the transaction at issue, as well as where the case stands.
The transaction and source of funds matter
The money laundering guide distinguishes federal Sections 1956 and 1957 and Texas Penal Code Chapter 34. The applicable provision determines what must be proved concerning unlawful proceeds, knowledge and any additional purpose or circumstance. Moving money does not automatically establish every element of money laundering.
Reconstruct the records before accepting a summary
A summary of transfers is a place to start. It still needs to be checked against the account records. Counsel may need the invoices, contracts, ledgers, and dates to work out what happened, especially when an account held both lawful and allegedly unlawful funds. Transfers between related businesses need that attention too. Who owned an account is one question; what a particular person knew or did is another.
Address connected fraud counts and property issues
Keep the indictment, property orders, and any notices with deadlines. Counsel needs them to review each fraud or laundering count and any request for forfeiture or restitution. Ask about lawful options for restrained funds. Do not transfer money to obstruct the case, and preserve your records.
Contact the office about the specific matter
Have a deadline coming up? Include it when you call, with the name of the court or agency handling the matter. It helps to know whether you are calling about an investigation or charges already filed. Referring lawyers are welcome to contact the office as well. Before sending records, ask how to provide them. The firm must check conflicts, its availability, jurisdiction, and the proposed work before accepting a case. No outcome can be promised: the facts and applicable law will govern.
